12. What happens when an expert medical witness is found, after testimony review, to have given erroneous expert testimony?

EMC provides that an expert consultant’s testimony or researchfound to be “significantly inconsistent”with the evidence presented or the accepted standards of care of his specialtyby unbiased review, may be censured from this organization by its board.  A report regarding membership status only will be made to responsible organizations uponrequest. The effect of censure from EMC membership for erroneous testimony willlikely result in lost credibility and de-selection for expert testimony infuture cases by trial court judges. defendants, and plaintiffs because of thiscensure.  Active experts will be diligent to avoid this censure and willtherefore be scrupulous in eliminating “frivolous “ testimony.
