13. How are EMC and its member physicians protected from litigation for is review activities?

EMC is a voluntary non-profit organization that performs peer review of expert medical witness testimony. All expert medical Physicians joining the organization, as “Fellows” must agree that the properly conducted peer review of expert testimony is the primary mission of the company. Acceptance of membership as a Fellow provides for a “hold harmless” condition of membership clause wherein the member agrees to hold EMC and its physicians involved in any review process harmless as to the pursuit of any litigation issue related to the testimony review process. In addition, any member agreeing to the voluntary review process for his medical witness testimony must agree to non-litigation provisions prior to beginning the review process. Finally, the proceedings of EMC as a medical peer review organization are protected from discovery as to the testimony review process.
