6. Does the clinical practice of an expert witness factor into the review of his prior expert testimony?

No. The clinical practice of an expert witness is not considered in the EMC testimony review process whatsoever. This includes any medicalboard or hospital clinical review reports or notices of disciplinary action. EMC will not undertake a testimony review of a physician who has anypending disciplinary action with any agency. The bylaws of EMC prohibit the presentation of any clinical patient management information, letters from outside parties or any other data other than the medical records, depositions, and trial testimony of the cases presented for reviewwherein the physician being reviewed submitted testimony.
